Compulsory Purchase Orders

What are Compulsory Purchase Orders?
Councils can use a compulsory purchase order in order to buy a piece of land or a building that the owner does not want to sell to them, or where the owners say they will sell but keep delaying, or where no one knows who the owner is.

They have to have a good reason for using these powers – for example, an empty property that could be used for housing, or land that is necessary for a major development.  The Council’s reasons for making a particular compulsory purchase order are set out in a document called the Statement of Reasons, which is sent to anyone who has an interest in the land or building.  It can also be consulted at the Town Hall Reception.

Who deals with them here?
When a compulsory purchase order is made notices are served on people who have a right to know (the owner of the land, any tenants and the bank or building society if there is a mortgage on the land). The Council will also put up a site notice and place an advert in the local paper for two weeks.  Copies of the documents are held at the Town Hall Reception and can be consulted by anyone.

Where have we made compulsory purchase orders in the past?
Compulsory purchase orders made by Great Yarmouth Borough Council have included 1 York Road, 12 flats left derelict and abandoned with their owner in prison.  It was subsequently sold at auction, ensuring their return to housing use.  Another compulsory purchase order was made to ensure a continued right of way over a small strip of land in Bradwell giving access to Gypsies Green.
