Guidance Notes for Personal Searches
Local Land Charge Fees (from 1 January 2010)
The Council keeps a wide range of information about land and buildings within the Borough. This information can affect your property or the property you may be interested in purchasing.
There are many Land Charge types and they may contain information about, for example, historic buildings grants which the Council may have given several years ago but which the owner may have to repay. Information such as road protection lines, Conservation Areas, land subject to compulsory purchase or houses affected by Closing Orders can be revealed on a Search. Planning consents are also covered.
This information is revealed by the result of a Local Land Charges Search. A Search is usually made by a Solicitor, Licenced Conveyancer or Home Information Pack (HIP) provider who will send a Search to the Council at Maltings House, Gorleston.
We do not have or hold details of:
Electricity, gas, water or telephone services
Restrictive covenants
Land ownership
Land or property boundaries

Submitting a Search
A Solicitor, Licenced Conveyancer or Home Information Pack (HIP) provider will usually submit a Search. You can, however, submit a Search yourself.
To submit a Search you must use special forms (LLC1 and CON 29) obtainable from:

An up-to-date site or property location plan will be needed so that we can identify the relevant parcel of land or property.

Guidance Notes For Personal Searches
If you would like to make a personal search of the Local Land Charges Register please contact the Land Charges Section on 01493 846425, 846326 and 846650 or e-mail landcharges@great-yarmouth.gov.uk to arrange an appointment. It is necessary to make an appointment at least 24 hours in advance. When calling please provide the following information:
Name and/or company
Address of property
Up to date location plan so we can identify the relevant parcel of land or property.

Appointments
Appointments start from 9:30 to 12:00 and 14:30 to 16:00 Monday to Friday.

The office is located just north of the traffic light junction at High Road/Beccles Road. A location map can be sent on request.
Please note appointments will be kept open for 30 minutes after which a new appointment will have to be made. This is to ensure staff coverage and to minimise staff disruption in undertaking their duties.
The following facilities are offered:
Payment can be made by cheque or cash and a receipt will be issued.
1. Statutory Search of the Local Land Charges Register. This entitles you to view the register. Staff will be unable to assist you with enquiries or questions. Fee £11.00.
2. Provision of a "data pack". Fee £40.00. This is a convenient and timely service provision that facilitates, co-ordinates and collates the data required into a single non-removable “data pack” per parcel of land. The pack includes the raw and/or part-refined data from which the personal searcher can extract appropriate information for the purposes of local enquiries.
The New Procedure (from 6 April 2009)
For your advice and guidance the following describes the procedure that will supersede the current arrangements for visitors to the Council offices when conducting a personal search and/or researching data in order to respond to local enquiries:-
1. An appointment system will be in place. In making the appointment the personal searcher will be required to confirm the service(s) required namely:-
a) A search of the Land Charges Register, for the statutory fee structure. This should take no longer than a maximum of 5-10 minutes per parcel.
Note: Personal searchers are reminded that a personal search is defined as a search of the Local Land Charges Register only. This is the service provided for the statutory £11 fee (plus additional parcels as appropriate). Enquiries and/or access to any other data is NOT included, whether currently free or chargeable. It is for this reason the appointment duration is expected to be within 5-10 minutes.
b) Provision of raw and part refined data required in order to determine responses to local enquiries. The time required will vary depending on the complexity of the property.
Note: The pack includes data provision for both free and chargeable items such that a personal searcher has all the raw/part refined data required to compile a response to local enquiries.
and:
c) Provide a current, clear and unambiguous plan that matches the textual address requested. The property footprint should be clearly outlined in red.
This is a critical stage as it will directly impact on the service provided and the preparations that need to be made prior to the appointment. Personal searchers should not expect to be able to modify their requirement on the day of the appointment.
2. On arrival at Reception the personal searcher will pay the appropriate fee, obtain a receipt and wait to be accompanied from Reception to the personal search facility.
3. In the event that 1(a) is required, the reference number will be provided such that the personal searcher can conduct a search of the Land Charges Register.
And/or:
In the event that 1(b) is required the relevant data pack will be provided such that the personal searcher can conduct local enquiries.
4. Ensuring that the data pack is left behind, the personal searcher indicates that they have completed their business and is accompanied back to Reception
Other Notes for Guidance
Since all land charges and raw or part-refined data will have been collated into one place for the convenience of the personal searcher, further contact with any Council Officer will not be necessary for the purposes of conducting the search.
Since preparation work commences immediately after the appointment is taken, the fee for 1(b) will still be payable for cancelled and missed appointments. Any such fees can be sent by cheque or paid at the time of a subsequent appointment. Access to the personal search facility will not be permitted until any such fees have been paid.
Whilst every effort will be made to collate all the data required in time, there may be occasions when available resources mean that the preparations cannot be completed prior to the appointment. Any such instances will require that the appointment be re-scheduled, at no cost to the personal searcher. In such an instance, contact with the personal searcher will be made by close of business on the working day prior to the appointment.
Staff have been advised not to give gratuitous information because of the legal implications. You should, therefore, be aware that you will be required to retrieve your own information from the records provided. This means that as an Official Certificate of Search form is not obtained, it is highly unlikely that this would be sufficient for mortgage purposes. Members of the public are therefore advised to contact their lender before proceeding.
Upon written request to Great Yarmouth Borough Council (see contact details on page 1) a personal searcher will be supplied with an office copy of any registration, document, map or plan connected to a registration. A statutory fee of £2.50 applies to Light Obstruction Documents and £1.50 for a copy of an entry in the Local Land Charges Register. Copies of original plans, maps and other items will be charged a reasonable fee according to the time and work involved if it does not infringe copyright.

Non - commercial:
To include individual dwellings including houses, bungalows and self contained flats either in residential or holiday use where the vendor is a private individual. It would also include individual building plots for residential properties where the site is either currently vacant or under construction.

All other types of search.
