The term nuisance is in common use but it is actually a legal term which has been developed over many years and has come to mean something which is stopping you from enjoying your land or property.
The Council can deal with many of these problems and they are all dealt with in broadly the same manner using powers contained in the Environmental Protection Act 1990.
Upon complaint, Officers will investigate to ascertain whether a “statutory nuisance” has been, is being or is likely to be caused.
Fortunately, most complaints are resolved informally, but if problems persist, the Council has powers to formally address the issues. Occasionally perpetrators may end up in Court and the Council may step in to do certain works. A key part of any nuisance investigation is for you to keep a diary of when the nuisance arises and the problems it causes you. The Council can supply a standard diary sheet that can be used.
The Council has produced noise and nuisance information packs and carries a number of information leaflets on certain types of nuisance.
