Licensing Act 2003 Licensing Policy

6. Public safety

6.1The 2003 Act covers a wide range of premises that require licensing, including, cinemas, concert halls, theatres, nightclubs, public houses, cafes/restaurants and fast-food outlets/takeaways.

6.2Each of these types of premises presents a mixture of hazards, with many common to most premises and others unique to specific operations. It is essential that premises are constructed or adapted and operated so as to acknowledge and safeguard occupants against the risks associated with these hazards.

6.3Where an applicant identifies an issue in regard to public safety (including fire safety) which is not covered by existing legislation, the applicant should identify in their operating schedule the steps which will be taken to ensure public safety (see Appendix 4).

6.4If the applicant does not address public safety issues in their operating schedule, it is likely that representations will be made. Where relevant representations are made, the Licensing Authority will consider attaching Conditions to licences to promote safety and these may include Conditions drawn from the Model Pool of Conditions relating to Public Safety (see Appendix 4).

6.5The Terrorism (Protection of Premises) Act 2025 otherwise known as 'Martyn's Law' has been developed to ensure public premises and events are better prepared for terrorist attacks, requiring organisers to take reasonably practicable steps, which vary according to their capacity, to mitigate the impact of a terrorist attack and reduce physical harm. We would expect all licensees to comply with any requirements set out within the Act as and when it comes into force.
