As an elected Councillor of Great Yarmouth Borough Council, I am the data controller for the purposes of the Data Protection Act 2018 (DPA) and the UK General Data Protection Regulations (UK GDPR). I am accountable for the processing of personal information in connection with requests I receive from constituents.
How I use your information
When you ask for my help and assistance, I will need to collect your personal data so that I can process your request or respond to your enquiry.
I will only collect the personal data from you that I need to provide you with relevant information, services or support. This data will generally include personal information such as your name, address and contact information together with details of your problem or concern.
The lawful bases relied upon under the General Data Protection Regulations is:
- Article 6(1)(a) - consent of the constituent making the request (or other relevant persons where this is appropriate)
- Article 6(1)(e) - public task discharging functions as an elected representative for the purpose of responding to requests from constituents
Data Protection law provides extra protection for some types of personal information due to its sensitivity. This information consists of:
- physical or mental health
- criminal convictions and offence
- racial or ethnic origin
- sexuality and sexual life
- religious or philosophical beliefs
- trade union membership
- political opinions
- genetic and bio-metric data
I may require your written consent to collect this type of information where it is of relevance to the request you are making.
Data Sharing
I may share your name, contact details and any personal data relevant to your enquiry with the relevant service within Great Yarmouth Borough Council, in order to investigate and address your issue. I may also need to refer the matter to another Elected Member if they hold the portfolio for the service your enquiry relates to.
Your details may also be shared with relevant partner agencies if relevant to your enquiry, such as County, Town or Parish Councillors / Officers and other public sector organisations.
I will not share personal details of constituents who contact me with anyone else unless I am required to do so by law or where this is for the for the prevention or detection of crime, or in connection with a criminal investigation.
If I cannot assist you in your query, I will advise you where you may seek further guidance (eg, County Council, other organisations), however I will not pass your details on myself.
Retention
I will keep your personal information for a year following the date your enquiry is closed, after which time it will be securely deleted. I will review dates for keeping personal data in the future and if necessary, update this privacy notice.
Your rights
You may have the right to:
- see copies of all the data held about you
- ask for it to be corrected or deleted
- request the Council restricts what it does with your data in certain circumstances
- object to what the Council may do with your data
- request not to be subject to a decision based entirely on automated processing
- data portability
Please note that these rights are not absolute and there are circumstances where they do not apply or where I may override these rights. In such cases, I will notify you in writing.
