Under what statutory powers would the Council require residents to leave their home and can demolition take place without the consent of the owner? What safeguards ensure human rights and property rights are protected?

The Council would only seek to use its powers under the Building Act 1984 in the event a property became dangerous and it was not possible to come to an advance voluntary agreement on the demolition of the property on safety grounds. In all instances, the Council's aim is to work with residents as erosion progresses, to help them understand the risk posed to the location of the property and its proximity to the cliff edge.

The Council will always work to understand individual property owners' needs and requirements, including the provision of housing advice, and regard is given to those with any protected characteristics or vulnerabilities. Human rights, such as property rights, are 'qualified rights' - that means they have to be balanced against the wider interest, i.e. they are balanced against public safety.
